CAMPERVAN HIRE AGREEMENT
This hire agreement applies to all campervan bookings with HuffPuff Campervan Hire. By confirming a booking, you agree to these terms.
TERMS AND CONDITIONS
Use of Vehicle:
The renter agrees to use the vehicle solely for lawful purposes, operating it in a safe and responsible manner at all times. Only the renter and any additional authorised drivers listed in this agreement are permitted to drive the vehicle. Unauthorised drivers or uses, such as towing, racing, or off-road driving, are strictly prohibited and will result in immediate termination of the agreement. The camper is to be used only in designated camping areas as specified by the rental company and is not to be driven on restricted roads or trails.
Condition of Vehicle:
The vehicle is provided to the renter in good condition, except for pre-existing damage listed in the previous section. The renter must return the vehicle in the same condition, excluding normal wear and tear. Any additional damage or issues noticed at the time of rental must be reported to the rental company immediately. Failure to do so will result in the renter being held responsible for any subsequent damage.
Fuel Policy:
The vehicle is provided with a full tank of petrol and must be returned with a full tank. If the vehicle is returned without a full tank, the renter will be charged a refuelling fee of £20 in addition to the cost of the petrol.
Mileage:
The rental includes unlimited mileage.
Prohibited Uses:
The vehicle must not be used for any illegal purposes, including but not limited to the transportation of illegal substances or contraband. The vehicle must not be driven by any person who is under the influence of alcohol, drugs, or any other substances that may impair driving ability. The vehicle must remain within the geographic area specified by the rental company: United Kingdom.
Safety Gear:
The renter must ensure all passengers wear appropriate safety gear at all times while operating the camper, including but not limited to seat belts. The renter is responsible for ensuring the safety of all occupants.
Insurance and Liability:
The rental company maintains appropriate motor insurance for the vehicle. The renter is liable for any excess applicable under the insurance policy in the event of damage, accident, theft, or loss during the hire period. The renter remains responsible for any loss or damage caused by negligence, misuse, breach of this agreement, or any uninsured event.
Insurance does not cover personal belongings of the renter or passengers. The renter agrees to indemnify the rental company against any third-party claims arising from the renter’s use of the vehicle, except where such claims result from proven mechanical failure not caused by the renter.
Maintenance and Repairs:
The renter is expected to carry out reasonable daily checks including tyre condition, visible fluid leaks, lights, and general roadworthiness.
The rental company remains responsible for mechanical condition and servicing of the vehicle unless damage or failure is caused by misuse, negligence, or breach of this agreement.
Any warning lights, faults, or mechanical issues must be reported immediately. Continued use of a faulty vehicle without consent may result in liability for resulting damage.
Breakdown and Accidents:
In the event of a breakdown, the renter must contact the rental company immediately. Assistance will be provided via roadside assistance or recovery service.
Replacement vehicles are not guaranteed and are provided solely at the discretion of the rental company and subject to availability, location, and timing.
The rental company accepts no liability for accommodation, travel costs, or missed events arising from breakdown or mechanical failure, except where required by law.
Return and Late Fees:
The vehicle must be returned at the agreed time and location. Late returns will incur a charge of £25 per hour or part thereof unless previously agreed in writing.
The rental company reserves the right to charge additional daily hire rates if the vehicle is not returned within 6 hours of the agreed return time.
Pets:
Small to medium well-behaved dogs are permitted only with prior approval. The renter is responsible for any damage, cleaning, or additional wear caused by pets.
Evidence of cats being present in the vehicle will result in a minimum £100 cleaning and deodorisation charge. The rental company reserves the right to apply additional charges where specialist cleaning or repairs are required.
Smoking:
Smoking inside the camper is strictly prohibited. Violation of this policy will result in a cleaning fee of £100 and the renter may be held liable for any damages caused by smoking.
Cleaning:
The vehicle must be returned in a reasonably clean condition. A minimum cleaning charge of £75 will apply if the vehicle is returned in a condition requiring professional cleaning.
Excessive cleaning requirements, including staining, biohazards, or heavy mess, may incur additional charges.
Towing:
Towing is prohibited unless explicitly approved by the rental company. The renter must not tow any vehicle or trailer without written permission.
Parking and Camping Restrictions:
The renter agrees to park and camp only in designated areas. The renter must comply with all local laws and regulations regarding parking and camping.
Interior and Appliance Use:
The renter is responsible for proper use of all interior features and appliances. Any damage due to improper use will be charged to the renter.
Additional Drivers:
Any additional drivers must meet the rental company’s requirements.
Booking, Payment, and Cancellation Policy:
A booking is secured upon receipt of the agreed booking deposit. The remaining balance must be paid in full no later than 42 days (6 weeks) before the start of the hire period. If the balance is not received by the due date, HuffPuff Campervan Hire reserves the right to cancel the booking and retain the booking deposit. Although customers do not have a statutory cooling-off period for vehicle rental bookings, HuffPuff Campervan Hire voluntarily offers the following cancellation period as a gesture of goodwill: For bookings made more than 42 days before the start of the hire period, customers may cancel within 14 days of paying the booking deposit and receive a full refund of that deposit, provided the cancellation is made more than 42 days before the start of the hire period. For bookings made within 42 days of the start of the hire period, customers may cancel within 48 hours of paying the booking deposit and receive a full refund of that deposit, provided the hire period has not commenced.
If a booking is cancelled by the customer more than 42 days before the start of the hire period, all payments made (excluding the booking deposit, unless cancelled within the goodwill cancellation period above) will be refunded.
If a booking is cancelled by the customer 42 days or less before the start of the hire period, all payments made are non-refundable.
If HuffPuff Campervan Hire is able to re-let the cancelled dates, a discretionary refund may be offered, less the booking deposit and any reasonable administration costs incurred.
Customers are strongly advised to obtain suitable travel insurance to protect against cancellation costs and other unforeseen circumstances.
Force Majeure:
The rental company shall not be liable for delays, cancellations, or inability to perform obligations due to events beyond reasonable control, including but not limited to weather events, natural disasters, road closures, or governmental restrictions.
In such cases, liability is limited to refund of unused hire days only. No further compensation shall be payable.
Dispute Resolution:
Any disputes arising from this agreement will be resolved through mediation or arbitration before resorting to legal action.
Indemnification:
The renter agrees to indemnify and hold harmless the rental company from any claims, damages, or expenses arising from the renter’s use of the vehicle, including but not limited to legal fees and costs.
Termination:
The rental company reserves the right to terminate this agreement at any time if the renter violates any terms or conditions. In such cases, the renter must return the vehicle immediately. The renter may terminate the agreement by returning the vehicle and paying any outstanding charges.
GOVERNING LAW:
This agreement shall be governed by and construed in accordance with the laws of United Kingdom.
ENTIRE AGREEMENT:
This document constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, either written or oral.
